Vanessa Marcil says she tried to stay on friendly terms with her ex Brian Austin Green following their break-up. But things eventually turned sour between the former couple. And now, the actress has made the shocking claim that Green has cut their son Kass out of his life – and left Kass crushed in the process.
On October 15, 1968, Marcil was born in Indio, California. She got her breakthrough role in 1992 as Brenda Barrett on the soap opera General Hospital. The actress starred in the show on and off until 2013.
Marcil also appeared opposite Sean Connery and Nicolas Cage in 1996 movie The Rock. Two years later, she landed the part of Gina Kincaid on Beverly Hills, 90210. It was there that she met Green, who portrayed David Silver on the show for its entire run.
By that point, Marcil was divorced from Corey Feldman. The couple had been married for four years before ending their romance in 1993. The rising star began dating Green during the late 1990s, and they became engaged in the summer of 2001.
Their son Kassius was born on March 30, 2002. The couple were due to marry that summer – but instead, they called off their engagement in 2003 for unknown reasons. And the following year, Green began a relationship with Megan Fox.
Green and Fox first encountered each other in the sitcom Hope & Faith. At the time, she was 18 years old and he was 30. The couple got engaged in 2006 and following a separation early in 2009, they rekindled their romance and married in Hawaii on June 24, 2010, with Kassius serving as the best man.
Fox and Green have since had three children together. Noah was born in 2012, and Bodhi came along two years later. The couple then separated and began divorce proceedings in 2015 but got back together the following year, a few months before the birth of their third child, Journey.
In 2012 reports surfaced claiming that Green had attempted to sue his former fiancée. According to the lawsuit, Green was trying to recover $200,000 that he’d allegedly lent to Marcil on the promise that she would repay him in the future. But the suit was dismissed because the statute of limitations had passed.
The judge was also reported to have informed Marcil that she had a right to claim money from Green, with E! alleging at the time that she subsequently asked for upwards of $50,000. And now the actress has claimed that the legal issues between her and Green have been going on for a lot longer than most people realized.
In a November 2018 Instagram post, Marcil stated that she’d “never spoken publicly” about what had happened – until now. “Twelve years ago I was served legal papers and then spent eight years plus defending myself and my son in custody court in response to his father and his stepmother trying to get full custody (that means I would have seen my son four days a month) and then asking me to pay them child support,” she wrote. “They lost that case and a civil case asking me for $200,000.”
Marcil claimed that she had always wanted to maintain joint custody of Kassius with Green, so that their son would have a healthy relationship with his father. But according to the star, that didn’t stop her ex from going after her in court. “In the end they lost all of these court cases. The judge called them all ‘frivolous,’” she wrote.
“They always had 50 percent custody and still did when court ended as I had and have NEVER asked for full custody,” Marcil added. However, apparently a few years ago everything changed. The 50-year-old alleged that Green had rejected Kassius – with devastating results.
“Five years ago on their own they decided to completely cut Kass out of their lives and his younger brothers’ lives,” Marcil wrote. “Kass has never met his youngest brother and is not allowed to know where his biological father, stepmother and three younger brothers live. He has only seen his dad in passing in public places.”
“Custody cases hurt the children only and the truth shall set us all free,” Marcil added. “Kass has been truly heartbroken since being cut out of his other family’s lives with NO explanation. Let’s do better for our kids. Let’s share our stories.”
So far, Green and Fox haven’t commented on the allegations. But Marcil is not backing down and stated that she hopes Green shares his side of the story. When fans pointed out that the actor had posted a photo of his son on social media earlier in 2018, she replied that Green “has given up on his 50 percent and only sees Kass in passing and only alone without his wife and kids.”
Marcil alleged that while Kassius had spent some one-hour lunches with his father and had also seen him at a wedding or a play “a few times,” Kassius is not allowed to know Green’s address and does not get invited to spend the holidays with Green and Fox. “They threw away his entire room and gave away his cat without Kass knowing,” Marcil claimed.
Fans were shocked by the claims against Green – and many of them rallied around Marcil. “All of these people with the ‘but I see ONE pic of Kass with [Green]’ this year… um how many involved parents only post one pic once a year of their kid?” one person wrote. Another agreed, “So Brian never sees his son? Meanwhile he dotes his other kids around! Shamefully arrogant!”
Marcil was also praised for having the courage to talk about the matter publicly. “I’ve always admired you for not being afraid to speak your truth,” another comment read. “Your son is blessed to have such a strong mother!”
Following her split from Green, Marcil wed Carmine Giovinazzo in 2010, although she and the actor separated two years later. She’s now engaged again, this time to a deputy sheriff. Kassius remains her only child following multiple miscarriages. And despite the alleged difficulties with Green, Marcil still expresses hope that her ex can rebuild his bond with their son.
“It’s actually painful for us to tell the truth about Kass’ birth dad,” Marcil wrote on Instagram. “We always loved him like a best friend in Kass’ young years, and I have always believed and hoped for the best for him and that he would stand up for himself. We have to give up on him now in order for my son to heal. I believe in miracles so we will see what the future holds.”
